On 29 June 2022, the European Union (EU<\/strong>, Union<\/strong>) and Ukraine signed the Agreement on the carriage of freight by road<\/em> (Agreement<\/strong>)[1]<\/sup><\/a> with the aim of liberalizing transit and bilateral international carriage freight operations between the Union and Ukraine.<\/p>\n\n\n\n In a nutshell, the Agreement cancels the bureaucratic obstacles to the carriage of goods between the Union and Ukraine as well as helps ensure supply chains and food security following Russia’s military aggression against Ukraine and its blockage of the sea ports.<\/p>\n\n\n\n According to the European Commission (Commission<\/strong>), the conclusion of the Agreement is in the interest of the Union not only because the latter has an interest in the stabilization of the Ukrainian economy but also because Ukraine is an important supplier of products such as grain and other foodstuffs, as well as because EU hauliers will obtain reciprocal rights to the territory of Ukraine.<\/p>\n\n\n\n Both Ukrainian and EU hauliers can enter, transit goods through, and operate between each other’s territories without special permits for transit and bilateral carriage freight operations. Therefore, from now on, EU and Ukrainian hauliers are entitled to cross the border as often and periodically as needed.<\/p>\n\n\n\n To recall, prior to signing the Agreement, road freight transport between the Union and Ukraine was governed by a number of bilateral agreements between the EU Member States and Ukraine, which imposed quotas on both Ukrainian and EU hauliers regarding transit and bilateral carriage freight operations.<\/p>\n\n\n\n The Agreement provides for the mutualrecognition of EU and Ukrainian driver documents, such as driving licenses. From now on, the Union and Ukraine exempt the holders of driving licenses issued by one of the parties from the requirement to hold an international driving permit.<\/p>\n\n\n\n To recall, foreigners coming to the EU Member States from non-EU countries are, as a general rule, allowed to drive a vehicle for six months (this is, for instance, the case for Austria). After the expiration of this term, the license will be expired and must be exchanged for one issued by the EU Member State.<\/p>\n\n\n\n The Agreement will be in force for the period of one year from the day of its signature, i.e., until 30 June 2023<\/strong>, with the possibility for its further extension.<\/p>\n\n\n\n In addition, the Union and Ukraine have signed a High-Level Understanding on indicative maps of the Trans-European transport network (TEN-T<\/strong>) in Ukraine<\/em> (Understanding<\/strong>)[2]<\/sup><\/a> in order to improve infrastructure connections between the EU and Ukraine. Following the Understanding, the EU will include Ukraine’s updated TEN-T maps in its legislation.<\/p>\n\n\n\n Apart from this, on 20 June 2022\u0431\u0431 Commission published the proposal for a regulation laying down specific and temporary measures, in view of Russia’s invasion of Ukraine, concerning driver documents issued by Ukraine in accordance with its legislation (Proposal<\/strong>)[3]<\/sup><\/a> which was adopted by the EU Parliament on 07 July 2022. The draft rules will now have to be formally adopted by the EU Council. The regulation will enter into force five days after its publication in the Official Journal of the EU.<\/p>\n\n\n\n In particular, the Proposal provides for the recognition of the valid\/extended Ukrainian driving licenses within the territory of the Union. Thus, persons granted the temporary protection status or other adequate protection under national law will be able to use their driving license on the EU territory as long as this status last. This means that a Ukrainian driving license will no longer need to be converted into an Austrian driving license six months after obtaining residence in Austria.<\/p>\n\n\n\n Apart from this, in the light of the overall grooving shortage of truck drivers, access of the Ukrainian professional bus and truck drivers to employment in the Union will be facilitated by setting forth the specific rules
